OSEP is responsible for monitoring states' compliance with the Individuals with Disabilities Education Act. As part of this monitoring, each year, OSEP reviews the State Performance Plan/Annual Performance Report (SPP/APRhttps://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fsites.ed.gov%2Fidea%2Fspp-apr%2F&data=05%7C01%7C%7Ca5d131b777a348915b9a08da90fab74b%7C84df9e7fe9f640afb435aaaaaaaaaaaa%7C1%7C0%7C637981703730616111%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&sdata=w9IsucaGheXpRSs%2BSaQRnqMzagnocKfleG2BOuYPWTo%3D&reserved=0), information obtained through monitoring visits, and any other publicly available information to determine how well each State meets the requirements of the IDEA. Specifically, we are considering whether and how to use data from the current SPP/APR (which can be seen in the Part Bhttps://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fsites.ed.gov%2Fidea%2Ffiles%2F2022_Part-B_SPP-APR_Measurement_Table.pdf&data=05%7C01%7C%7Ca5d131b777a348915b9a08da90fab74b%7C84df9e7fe9f640afb435aaaaaaaaaaaa%7C1%7C0%7C637981703730616111%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&sdata=Q%2Bgk%2FdJ8KiRo9mf%2Fu11ydBRpfxkbV8lYdacgIRrJIUE%3D&reserved=0 and Part Chttps://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fsites.ed.gov%2Fidea%2Ffiles%2F2022_Part-C_SPP-APR_Measurement_Table.pdf&data=05%7C01%7C%7Ca5d131b777a348915b9a08da90fab74b%7C84df9e7fe9f640afb435aaaaaaaaaaaa%7C1%7C0%7C637981703730616111%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&sdata=yDhks0NhOLBHDD%2BQBQDGvKrR83jZGbmu6FrfDs5q90I%3D&reserved=0 measurement tables), data from the current IDEA 618 data collectionshttps://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww2.ed.gov%2Fprograms%2Fosepidea%2F618-data%2Findex.html&data=05%7C01%7C%7Ca5d131b777a348915b9a08da90fab74b%7C84df9e7fe9f640afb435aaaaaaaaaaaa%7C1%7C0%7C637981703730616111%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&sdata=86s7r0na2uiujohUH50%2BDbEPstKvQGhPR0pVa%2FTha9k%3D&reserved=0, and other publicly available data. For example, OSEP is thinking about how to consider and weight data when making determinations in a manner that accurately represents the implementation of IDEA and results for historically marginalized populations. The Department recognizes that the determinations process is complex, and we welcome suggestions for improvements and innovative solutions.
If you would like to share your feedback, please email SPPAPR@ed.govmailto:SPPAPR@ed.gov and include “Determinations Feedback” in the subject line. Feedback should be submitted by September 30, 2022. The Department will not respond to individual comments but will consider any feedback that is submitted by September 30, 2022.
Thank you.
